01 Agreement to Terms

By engaging Lakefront Sites for web design or development services, you ("the Client") agree to be bound by these Terms of Service. These terms apply to all projects, packages, and services provided by Lakefront Sites, operated by its sole proprietor based in Kelowna, British Columbia, Canada.

If you do not agree with any part of these terms, please do not proceed with a project.

02 Services Provided

Lakefront Sites provides website design and development services including but not limited to:

  • Starter website builds (1–3 pages)
  • Business website builds (multiple pages, custom design)
  • Custom web projects with advanced features
  • Basic SEO configuration
  • Post-launch support and maintenance (where agreed upon)

The specific scope of services for each project will be agreed upon prior to work commencing. Any work outside the agreed scope is considered a change request and may be subject to additional fees.

03 Payment Terms

3.1 Deposit

A non-refundable deposit of 50% of the total project fee is required before any work begins. Work will not commence until the deposit has been received and confirmed.

3.2 Final Payment

The remaining 50% balance is due upon completion of the project, prior to the website going live or final files being delivered. The website will not be launched or transferred to the client until full payment is received.

3.3 Payment Methods

Lakefront Sites accepts payment via e-transfer, cash, and credit card. Invoices will be issued for all payments.

3.4 Late Payment

If the final balance is not received within 14 days of the project completion date, Lakefront Sites reserves the right to take the website offline and withhold delivery of files until payment is made in full.

3.5 Refunds

The 50% deposit is non-refundable under all circumstances, as it covers time and resources already committed to your project. If a project is cancelled by the client after work has begun, the deposit will be retained. If cancelled by Lakefront Sites, any deposit paid beyond work already completed will be refunded.

04 Revisions & Scope

Each project includes a reasonable number of revisions as discussed during the kickoff call. A revision is defined as a minor change to existing content or design — such as adjusting colours, text, or layout within the agreed scope.

The following are not considered revisions and will be quoted separately:

  • Adding pages or sections not included in the original scope
  • Significant redesigns after a draft has been approved
  • New features or functionality not discussed at project start
  • Content rewrites beyond minor copy edits

Lakefront Sites will notify the client before undertaking any out-of-scope work and provide a revised quote. Work will only proceed once the client has approved the additional cost in writing.

05 Client Responsibilities

To ensure your project is completed on time, the client is responsible for providing the following in a timely manner:

  • Logo files (preferably PNG or SVG with transparent background)
  • Photos and images to be used on the website
  • Written content (page text, service descriptions, about info, etc.)
  • Access to existing domain registrar or hosting accounts if applicable
  • Timely feedback and approvals at each stage of the project

If the client fails to provide required materials within 14 days of request, Lakefront Sites reserves the right to pause the project or adjust the delivery timeline. Projects delayed by more than 30 days due to missing client content may be subject to a restart fee.

06 Ownership & Intellectual Property

6.1 Client Ownership

Upon receipt of full and final payment, the client owns the completed website in its entirety, including all custom design elements, written content supplied by the client, and the overall layout created for the project.

6.2 Third-Party Assets

The client is responsible for ensuring they have the legal right to use any content, images, logos, or other materials they supply to Lakefront Sites. Lakefront Sites is not liable for any copyright infringement resulting from client-supplied materials.

6.3 Portfolio Rights

Lakefront Sites reserves the right to display completed work in its portfolio, website, and social media for promotional purposes, unless the client requests otherwise in writing prior to project launch.

6.4 Stock Assets & Third-Party Tools

Some projects may incorporate licensed stock photos, fonts, or platform-specific templates (e.g., Squarespace, Wix). These assets remain subject to their respective license agreements and are not exclusively owned by the client.

07 Project Timeline

Most projects are completed within 2–4 weeks from the date the deposit is received and all required content has been provided by the client. Timelines are estimates and may vary depending on project complexity and client response times.

Lakefront Sites will communicate any delays promptly. The client's failure to provide timely feedback or materials is the most common cause of project delays and is not the responsibility of Lakefront Sites.

08 Post-Launch Support

Lakefront Sites includes 14 days of post-launch support at no additional cost. This covers minor fixes, adjustments, and questions related to the completed website.

After the 14-day support period, any updates, changes, or ongoing maintenance will be quoted separately. Clients interested in ongoing support may inquire about a monthly maintenance retainer.

09 Limitation of Liability

Lakefront Sites provides services in good faith and to the best of its ability. However, Lakefront Sites is not liable for:

  • Loss of revenue, business, or data arising from website downtime or errors
  • Issues caused by third-party platforms, hosting providers, or domain registrars
  • Search engine ranking results or marketing outcomes
  • Security breaches outside of Lakefront Sites' direct control

In no event shall Lakefront Sites' total liability exceed the total amount paid by the client for the project in question.

10 Confidentiality

Lakefront Sites agrees to keep confidential any sensitive business information shared by the client during the project. The client agrees to keep any pricing, processes, or proprietary methods of Lakefront Sites confidential.

11 Governing Law

These Terms of Service are governed by the laws of the Province of British Columbia, Canada. Any disputes arising from these terms or services provided shall be subject to the jurisdiction of the courts of British Columbia.

12 Changes to These Terms

Lakefront Sites reserves the right to update these Terms of Service at any time. The most current version will always be available at lakefrontsites.com/terms. Continued engagement with Lakefront Sites after any changes constitutes acceptance of the updated terms.
